Rick's commentary

In response to your letter I received on the 25th of August Letter
1.) I have been in communication with you when appropriate and as needed.
Sighting (sic) my letter to you on August 9th where in;
No, he has not
a.) I demanded you cease and desist from calling me and leaving me messages Collection activities are authorized
b.) I stated; "...you have destroyed any possibility of a working relationship between us." No, Mickey has
c.) I wrote you a $100.00 check to begin re-payment of the $2200.00 The amount left is $2400
d.) I stated the check "...accepted by you here in substantiates you are willing to accept my repayment of $2200.00...as stated..." No it does not.
I am entitled to deposit whatever Mickey sends
You have cashed the check for $100.00 showing you are in agreement with the repayment terms offered in my letter dated August 9, 2010. No, I never agreed to that.
Mickey owes $2400 now.
To date approximately 16 hours of time has been lost in dealing with this matter at the rate of $35.00/hour, 8 of which have occurred since you cashed the check. Mickey cost Rick more than 16 hours of time at $60 per hour.
I will continue to track additional time lost to you, should you continue requiring further attention, and reduce the amount of repayment to you accordingly, beginning on the day you cashed the check. Mickey is just asking for Small Claims Court action.
There is no need for further comments or communication between us, as this matter has been settled. Yes, we are going to Court
Sincerely,
Mickey Elston
