No crime was committed.  It is totally legal by Iowa Code 711.4(3)
to warn fellow citizens about a con artist, if you have a Good Faith Claim.
Judge Showers dismissed and expunged the absurd charge on May 3, 2021.

Mickey lied to "Play the Victim" and use the Court
while he has been convicted of Contempt of Court.
He was not sincere in his Police report, and submitted altered evidence to authorities
in violation of Iowa Code 718.6

718.6 False reports to or communications with public safety entities.

1. A person who reports or causes to be reported false information to a fire department, a law enforcement authority, or other public safety entity, knowing that the information is false, or who reports the alleged occurrence of a criminal act knowing the act did not occur, commits a simple misdemeanor, unless the alleged criminal act reported is a serious or aggravated misdemeanor or felony, in which case the person commits a serious misdemeanor.

2. A person who telephones an emergency 911 communications center knowing that the person is not reporting an emergency or otherwise needing emergency information or assistance commits a simple misdemeanor.

A person who knowingly provides false information to a law enforcement officer who enters the information on a citation commits a simple misdemeanor, unless the criminal act for which the citation is issued is a serious or aggravated misdemeanor or felony, in which case the person commits a serious misdemeanor.

Then 7 days later, plenty of time to truncate the file in half, he went to the Police.

One week after the call, Mickey had the chance to cut off the last 1/2
of the voice mail, to make the phone message sound more "extortive"
cutting off Shaddock's offer of working off his debts "if you want to work something out"
"You can pay me last" (after 30 other victims) and "pay your judgments as Judge Waggoner ordered. Bye."
He played his version for a Police Officer, claiming "defamation", who said it was a Civil matter.
Mickey went to Police again for a year, claiming "harassment", trying to get Shaddock arrested.
Finally on March 3, 2020, Mickey alleged the voice mail was "extortion", a felony.
At a Deposition hearing, Mickey was asked why he kept asking the Police. 
Mickey answered (under oath) "a squeaky wheel gets the grease."

Detectives Notice the Missing End Button Click

Mickey's call MP3 ends with perfect silence after "641-472-5830" from 0:01:22.728 - 0:01:24.588 for 1.86 seconds
which may be the Sheriff's making a click noise with his Sony recorder. It is a different sound from the End Call Click.

Mickey's truncated version has no sound whatsoever after the final words, indicating editing software was used.

But there should be a slight click as Shaddock presses the off button to "hang up" on Mickey's version too.
The downward stroke on the physical Off Button, near the microphone,  is the last sound transmitted by a call on this phone.
It is a physical button which vibrates the phone for a split second, just before the phone signal terminates.
The call has not ended when the thumb is on the downward stroke for about 2.5 millimeters.

Mickey's truncation of the voice mail in 1/2 proves he was not a sincere "victim" of extortion.

Shaddock's MP3 has just 0.314 seconds of silence from "Bye!" to the End Button Click

Mickey's vm recording should end with this End Click too.  But it does not. 
His version ends with 1.86 seconds of silence.
The End Button Click is an audible part of the call that Mickey should have heard.

Mickey could have learned to use this app in 7 minutes, and had 7 days.

Create Date Inconsistency

Shaddock's phone showed the voice mail was left on February 12, 2019 at 8:41 pm
Zip files preserve the original creation and modification dates

Mickey's phone showed the same date and time on his Voice Mail Log.
However the file in the police report, "Elton Voicemail.MP3" was dated as Created on March 31, 2020
The Modified date is March 31, 2021.   Why?  There should be no modifications to the file.
The Created and Modified dates should be 2/12/2019 8:41 PM.

JUDGMENT ORDER

A hearing was held on Oct 12th, 2010.  The plaintiff appeared in person pro se.  The defendant, likewise, appeared in person pro se.  The case involves the refund of monies paid as a deposit for excavation work which was not completed.

The Court finds, at the time of the estimate and payment of the down payment, that Plum Grove LLC was a valid company and had not been administratively dissolved.  The Court further finds that the existence of the LLC is not determinative of the issue of liability in this case. Thomas Prior, a local concrete contractor, testified that all excavation work done with Millard Elston was with the defendant personally.  He referred the defendant to Frederick Shaddock.  the defendant testified that he was not a part of Plum Grove LLC which was owned by his wife.  At no time during the inspection and estimate of the project did the defendant indicate that he was an employer or that this work was to be done by a corporation or LLC.  The only indication of LLC involvement was when the defendant requested that the down payment be made payable to Plum Grove LLC.  If the defendant wishes to hide behind a corporate shield he must establish adequate notice to the plaintiff that the LLC was the contracting entity.  He failed to do so.

The defendant admitted that a refund was due but requested $300 for work done.

The Court notes that the plaintiff was the reason for the delay in completing the project.  The Court allows $200 for compensation to the defendant, and a credit for $100 repaid.

Judgment against the defendant Millard Elston III in the amount of $2200.00 with interest at 2.26% from Nov 2, 2010, plus court cost of $101.50.  The defendant has seasonable employment therefore: it is further ordered that he foregoing judgment be paid at $100 per month beginning November 15, 2010, and on the 15th of each month through April 15t.  Beginning May 15th payments shall be $200 per month until paid in full.

SO ORDERED this 2th day of November  2010.
